GENERAL CONDITIONS OF USE OF THE AMADORI GROUP WEBSITES

All Amadori Group websites are controlled and managed by Gesco Società Cooperativa Agricola, Via del Rio 400, 47522 San Vittore di Cesena (FC).
Access to the websites of Gesco Società Cooperativa Agricola (also 'Amadori' or 'Amadori Group') and the use of the services and contents provided through them are regulated by these General Terms and Conditions of Use (also 'General Terms and Conditions')
Amadori Group reserves the right to modify, add or eliminate parts of these General Terms and Conditions, bringing them to the attention of Data Subjects by publishing the modifications on its Websites. Each User is required to periodically check this page for any changes that have occurred since they last consulted the Website. In any case, accessing, consulting the Websites and using the Services provided implies acceptance of the changes that have occurred in the meantime.

1. Definitions

The meanings of the main definitions used in these General Terms and Conditions are specified below
a) Gesco Società Cooperativa Agricola: manager of the Websites and of the domains and sub-domains registered for each of the brands and of the Amadori Group company, including, by way of example but not limited to, Campese, CuorLeggeri, Fidatissimi, etc., owner of the domains, owner of the Websites, Services and Contents provided through them, manager and/or owner of all IT and non-IT infrastructure to support them;

b) Websites: web portals attributable to the Amadori Group, consisting of all the Services and Contents made available to Users

c) Services: set of activities and operations that Users can perform in relation to the Contents made available through the Websites.

d) Contents: by way of example but not limited to, texts, documents, audio-video materials, information, graphic elaborations, photographs and/or images, illustrations, drawings, logos, works and any other type of original or reproduced creation material, published on the Websites or sent through them, including the software, the operating logic of the Websites, menus, web pages, layout, graphics and colours.

e) User: User of the Websites and the Services provided through them.

2. General Rules

2.1 Access to, consultation of the Websites and/or use of even just one of the Services provided through them by the User constitutes confirmation of acceptance of these General Terms and Conditions. If the User does not accept these General Terms and Conditions, they are requested not to access or use the Contents and Services offered through our sites.

2.2 By accessing the Websites and the related Contents and Services, the User commits not to use them to pursue illegal purposes or commit illegal activities and not to use them in such a way as to interrupt, damage or compromise their efficiency and functioning in its entirety or in part. The User acknowledges and accepts and acknowledges that access to them and the use of the Services are carried out at their discretion and under their total and exclusive responsibility. Amadori Group cannot be held liable for the conduct of the User while using the Websites and Services, nor does it assume any responsibility for any damage to the computer and other equipment of the User and/or third parties, or to data stored on it, without prejudice to any liability for wilful misconduct and gross negligence attributable to the Amadori Group.

3. Warranties and Liability

3.1 Except in cases of damage caused by wilful misconduct or gross negligence, Amadori is not liable for losses or damages connected in any way to the use and functioning of the Website, including without limitation, damages deriving from suspension, interruption, non-functioning and/or inaccessibility to the Websites and Services.

3.2 Amadori Group does not guarantee that the Website, Services and Contents will be provided without uninterruptedly, quickly and safely; that any material errors in the Contents and Services provided through the Website will be promptly corrected; that the Website, the Services and the Contents will meet the needs and expectations of the User.

3.3 The images and photographic representations on the Website are for illustrative purposes only. Amadori adopts measures aimed at ensuring that the photographs shown on the Website are faithful reproductions of the original products, including the adoption of every possible technological solution to reduce inaccuracies to a minimum. Nonetheless, some variations attributable to the technical characteristics and colour resolution of the computer and information systems used by the User are always possible. Amadori is not responsible for any imprecision and/or inadequacy of the graphic representations of products shown on the Website in cases attributable to the aforementioned technical reasons.

4. Data Transfer

Personal data may be stored in paper archives located at the Company's headquarters (FC), Loc. San Vittore and on servers located within the European Union.
In any case, it is understood that the Data Controller, if necessary, will also have the right to move the servers and archives outside the EU. In this case, the Data Controller hereby ensures that the transfer of data outside the EU will take place in compliance with the applicable legal provisions, subject to the stipulation of the standard contractual clauses required by the European Commission.

4. Minors

4.1 The use of the Websites and Services that require registration or the provision of data and information is permitted only to people over the age of 18. No one under this age must register on the sites or use the services made available through them, except in cases where the minor has previously obtained the consent of a parent or legal guardian. By accessing and using even just one of the Services that require registration or the provision of data and information provided through the Websites, the User guarantees that they are of legal age (18 years) and possess the legal capacity to exercise the rights and to assume the obligations it has.

5. Trademarks, domain names and intellectual property

5.1 Gesco Società Cooperativa Agricola is the exclusive owner of its logos and registered trademarks, present and future, and of any other distinctive sign that includes the related words, including the related registered domain names. Amadori reserves the right to make exclusive use of its logos, brands and distinctive signs.

5.2 The User acknowledges that the Contents on the Websites are protected by current regulations on copyright, trademark and patent protection and/or by other legal provisions. Such Contents may not be copied, modified, reproduced or used in any other way, without explicit and express authorisation issued in writing to the User by Gesco Società Cooperativa Agricola, also on account of further contractual and negotiating agreements in place between the parties.

6. Cookies and links

6.1 The Amadori Websites also use cookies issued by third parties. For information on the policy of use of cookies by the Amadori Websites, you can consult our Privacy Policy

6.2 The Websites may contain links to other websites unrelated to the Amadori Group. These websites are in no way managed or controlled by Amadori, which cannot in any way be held responsible for the contents and rules present on them. These General Terms and Conditions are applicable exclusively to the Amadori Group Websites and not to other websites that may be consulted by the User via links.

7. Uploads and User Submitted Content

7.1 Some Services provided by the Websites (e.g. events, competitions and thematic initiatives of an extraordinary and temporary nature) allow the User to send and upload Contents, which due to the nature of the Services themselves, are intended for communication and dissemination. By using these Services, the User declares to know and accept these General Terms and Conditions, guaranteeing that the use is carried out at their discretion and under their own total and exclusive responsibility, except in cases of wilful misconduct or gross negligence attributable to the Amadori Group.

7.2 Amadori Group implements a policy of verification and selection of the contents and images sent by removing, at its free and incontestable judgement, from its systems, all the images whose content violates the rules indicated on this page.

7.3 The User is required to abide by the prohibition on sending illegal and/or abusive images and contents, which violate the rights of others or which violate, or may violate, the right to privacy, intellectual or industrial property rights or other rights of third parties, pornographic and/or sexually explicit, slanderous or defamatory, threatening, harmful, vulgar, obscene or otherwise reprehensible or offensive, in compliance with current legislation and the rules of conduct shown on this page. Amadori Group cooperates with the Public Authority in all cases in which it is requested to provide the data and/or information necessary to trace the perpetrators of any offences.

7.4 The publication of the opinions sent by the User does not represent the expression of opinions or advice by the Amadori Group; in particular Amadori does not recognise the contents of such opinions as its own.

7.5 The User acknowledges and accepts that any Content sent when using the Websites and Services can be removed, modified, disseminated, communicated and used by the Amadori Group. The User acknowledges that the rights of use relating to the Contents sent are transferred to Amadori free of charge, and renounces any material and moral right they can claim as author with respect to the Contents sent, granting the Amadori Group unlimited non-exclusive use rights, without limitations of means and geographical areas. Amadori Group may therefore, directly or through third parties, use, copy, transmit, extract, publish, distribute, publicly perform, disseminate, create derivative works, host, index, memorise, annotate, encode, modify and adapt (including without limitation the right to adapt for transmission with any means of communication) in any form or with any tool, current or future, any Content, including audio and video, which may be sent by the User, including through third parties.

7.6 The User who sends images and portraits releases the Amadori Group to release the use of the images themselves for the purposes and under the conditions set out in the following General Terms and Conditions. In particular, it recognises the Amadori Group's right to use all or part of the images sent, which may be used, by virtue of this recognised right, as a whole or in their individual parts and components, including through editing, cuts and adaptations, without limitation, except for the use of the images themselves in contexts that may cause damage to the dignity, reputation and personal decorum of the person concerned and their close relatives. The User acknowledges the Amadori Group's right to reproduce, publish, disseminate, communicate, perform and perform in public, in any place and by any means (e.g. internet, screening during public events, publication in catalogues and magazines, etc.) of the aforementioned images, recognising Amadori Group as the sole and exclusive owner of the images and footage, as well as all rights of use and exploitation in any form and by any means, present and future. The User waives, starting from the moment of sending, any right in relation to the foregoing, regardless of whether or not the images include representations concerning their person.

7.7 The User acknowledges and accepts that the material sent will not be returned and will remain the property of Amadori Group, which therefore remains exempt from any liability towards the User for the loss or destruction of the material sent.

7.8 The Services provided by the Websites that allow the User to send and upload Contents are intended for personal use unrelated to any commercial, business and professional activity attributable to the User or to third parties, subject to any specific exceptions expressly indicated.

7.9 The User declares that the Contents sent are authentic, not covered by copyright, at the full disposal of those who sent them and not burdened by third-party rights of use, relieving Amadori from any liability in the event of disputes or actions, by anyone undertaken, regarding these rights.

7.10 The User guarantees the Amadori Group, in the event that the Contents sent contain data relating to third parties, that they have acquired the necessary releases and authorisations from them, and undertakes to keep Amadori harmless from any and all claims made by these including any legal action taken.

7.11 In using the Services provided by the Websites that allow people to send and upload Content, the User declares to have read and understood the General Terms and Conditions and to accept them in all their parts. To this end, the User undertakes to observe the following rules:
- use respectful language, in particular free from violent, offensive, obscene terms and expressions;
- not to publish content that is intentionally false, offensive, unlawful, defamatory, slanderous or obscene, or that is in any way contrary to the law or intentionally harmful to third parties;
- not to publish Content aimed at spreading political, spiritual or religious ideologies;
- not to violate the privacy of third parties (for example by revealing first and last names, mobile numbers or addresses and, in particular, to avoid providing personal information regarding minors under the age of 18). For uploading photos and/or videos of people, the User who inserts Contents concerning minors under the age of 18 must have obtained the explicit consent of the parents or whoever has guardianship;
- always verify the validity of the data included in the Contents, always cite the source of texts and/or articles written by someone else, comply with the laws in force in Italy regarding patents or other industrial and/or intellectual property rights, trademarks registered, of performance or name of third parties;
- not to publish Contents that involve the violation of copyright without mentioning the author and the original source;
- not to use the Contents for own or third party commercial, advertising or promotional purposes;
- not to publish hidden or explicit advertising messages.

9. Applicable law and jurisdiction

9.1 These General Terms and Conditions shall be governed by and construed in compliance with the laws of Italy, without prejudice to any other overriding legislation of the User's country of habitual residence. Consequently, any disputes inherent and/or consequent thereto shall be settled exclusively by the Italian courts. The competent court for the application of these General Terms and Conditions is the Court of Cesena, Forlì branch.

10. Italian Legislative Decree 231-01
In compliance with the legal obligations established by Italian Legislative Decree 231/2001, which introduced the 'administrative liability of legal persons, entities and associations' for crimes committed in their interest or to their advantage by persons linked to the legal entity by specific legally established relationships, Gesco Società Cooperativa Agricola has decided to adopt an Organisation, Management and Control Model suitable for preventing the crimes identified by the aforementioned legislation, and to create a Supervisory Body with independent powers of initiative and control.
